REPORT FROM KAUAI COUNTY – Fifth Circuit Court Judge Randal Valenciano today ruled on the mayor’s authority to suspend the police chief.
Citing the Kaua’i County Charter, Article VII, Section 7.05 relating to the mayor’s powers, duties and functions, Judge Valenciano ruled that the mayor, as chief executive officer of the County of Kaua’i, does have the power to: except as otherwise provided, exercise direct supervision over all departments.
“We are pleased that the court has confirmed our position and now look forward to moving beyond this to focus on the many important matters that face the County,” said Mayor Bernard Carvalho, Jr.
