County continues efforts to secure Hanalei parcels through condemnation

REPORT FROM KAUAI COUNTY – Pursuant to an ex parte order granted by Fifth Circuit Court Judge Randal G.B. Valenciano on May 3, the County is attempting to take possession of three parcels in Hanalei owned by Mike Sheehan and Hanalei River Holdings Limited.  This action is the culmination of condemnation proceedings that have been ongoing for approximately 18 months.

The County has taken possession of the parcel referred to as “Lot 7” on the attached map, and has attempted to take possession of the parcels labeled “Lot 5” and “Lot 6,” however Mr. Sheehan has challenged the County’s right to do so.  The County intends to seek further guidance from the Fifth Circuit Court in order to facilitate the full implementation of the ex parte order.

“We hope the courts will assist in resolving this issue in an amicable and timely manner,” stated Mayor Bernard Carvalho, Jr. “It is the goal of all involved to complete this transaction so that long-term planning for the expansion of Hanalei/Black Pot Beach Park can commence as soon as possible.”
